Justice Ayesha Malik’s education

Ayesha Malik was born in 1966. She got her early education from Paris, New York, and Pakistan. She completed her A-Levels from Francis Holland School for Girls in London. Moreover, for higher studies, she went to Karachi and studied B.Com at the Government College of Commerce and Economics, Karachi. After that, she went to Lahore to pursue her law degree. She studied at the Pakistan College of Law, Lahore. Afterwards, she completed her LLM from Harvard Law School.

She is also an author of Why Trade in Financial Services: An assessment of the Agreement on Trade in Financial Services under the GATS and a number of more publications.

She has appeared in high courts, district courts, baking courts, and special tribunals also. Justice Ayesha also holds expertise in the family la cases conducted in England and Australia. Further, she is also well-known for dealing with issues such as child custody, constitutional rights of women in Pakistan and divorce cases.

About the decision

The decision of rank elevation is to take place on September 9th 2021. The meeting of the Judicial Commission will be chaired by Justice Gulzar Ahmed. The seat of Mushir Alam is to become vacant as he is getting retired on August 17. Hence, Justice Ayesha is nominated for that seat in Supreme Court.

Ayesha Malik belongs to Lahore high court. On a seniority basis, she stands fourth on the list. Back in 2012, she became the Lahore High Court Judge. If she gets promoted, she will have to work in the SC till 2031. Further, after 2031 when Justice Yahya Afridi will retire, she will become the CJP.

According to Express Tribune, Attorney General for Pakistan Khalid Jawed Khan during the JCP meeting highlighted the absence of women on the SC bench. However, Ayesha Malik’s nomination has nothing to do with the seniority principles. The decision is getting a lot of support from the whole nation.

Her important achievement was the declaration that virginity tests for rape survivors have no medical value. She declared it back in June. She further mentioned that such tests only humiliate the victim and are medically insignificant too. In a 30 page judgment, she called it offensive for the victim’s dignity. She mentioned,

“offend the personal dignity of the female victim and therefore is against the right to life and right to dignity enshrined in Article 9 and 14 of the Constitution”.

As soon as the news broke out, Twitter was full of warm wishes for the lady. The majority of people supported the decision. People called this decision a milestone in Pakistan’s fight for gender equality.

Pakistan Bar Council to look into the elevation of Justice Ayesha!

On Friday, PBC Chairman Khushdil Khan expressed his concerns over the nomination of Justice Ayesha while ignoring all other senior judges. The PCB Chairman stressed the fact that this decision is against the seniority principles.

“This very fact is predominantly against the principle of seniority as laid down in the judges’ case.”

Hence, it would have an adverse effect on other judges’ judicial work in the high court. However, the decision is to be discussed but the Chairman clearly explains that a decision to pick and choose one couldn’t be followed. The authoritative needs to consider the seniority principles.
